Course Introduction: Understanding jurisprudence is crucial for any legal professional, scholar, and especially for law students as it provides the philosophical foundation upon which legal systems functions. This course emphasizes the significance of studying Indian jurisprudential traditions which have been neglected, ignored and never take sincerely in legal academia since the beginning of legal education in India which is unfortunate and reflects our shallow understanding of our own legal heritage.
This course will enable the students to grasp the diverse perspectives that shape legal thought in Indian soil which is still a living tradition of Indian society and forms the non-formal and legal plural system of India. The exploration of the Indian perspective on legal rights, justice theories, and historical legal systems contributes to a comprehensive understanding of the correlation between law and society.
The inclusion of topics such as the origin and nature of jurisprudence, legal rights, schools of jurisprudence, and the history of legal systems in India is justified by their foundational role in shaping legal thought and practice. The inclusion of readings from original manuscripts and scholarly writings alongside modern jurisprudential theories will provide a balanced approach between Western and Indian jurisprudence and allow students to appreciate the evolution of legal thinking over time from an indigenous perspective.
